Payment terms :

If the departure is more than 3 months

-First instalment : 40 % at signature of the agreement
-Second instalment : 30 % two months prior to departure

-Balance : one month prior to departure

If the departure is more than 1 month

- 100 % at signature of the agreement

The payment of the first instalment can be made via cheque payable to Cool Sailing UK, Ltd. wire transfer to Barclays bank, Sutton Coldfield branch Sort Code : 20-84-13 Account No : 20773263 ; or credit card on Cool Sailing UK's website. Failure to return this contract and the general boat rental terms agreement signed with the first instalment payment to CSUK within 8 days will result in the cancellation of this reservation. .

GENERAL BOAT RENTAL TERMS

Preamble : Cool Sailing has in force an agreement with the local boat rental company represented on Cool Sailing UK's website and selected by the renter. The local boat rental company is responsible for delivery of all the specifications listed in the accepted boat offer

1 : Insurance and Deductable
1.1 the local boat rental company acknowledges that it has in force an insurance policy covering the renter and passengers for any damages incurred to the boat and its equipment, fire, theft, loss of vessel and personal liability.The premium is included in the rental price.The renter may choose to take supplemental insurance to cover any deductable.
1.2 The insurance policy does not cover personal injury to the renter and any other passenger. The renter and guests should makce certain they are covered elsewhere.
1.3 The local boat rental company is not responsible for the loss or damage of any personal property belonging to the renter and passengers..
1.4 Night cruising is forbidden in the Caribbean Islands and Polynesia.

2 Boat delivery
2.1 The local boat rental company will deliver the boat to the renter after the following conditions have been met : - signed contract and general boat rental terms - payment of the rental agreement in full - supplementary local agreements( inventory..) and deposit if applicable have been executed. The local boat rental company must provide the renter with a boat ready to cruise, equipped and insured according to the relevant regulations for the boat category.
2.2 The local boat rental company will provide the renter with copies of any supplementary local agreements between the two parties and the official boat papers.The renter will provide the local boat rental company with proof of any required boating license to operate the vessel.The renter will have 24h after taking delivery to assure the good condition of the boat and its equipment.The local boat rental company will provide the renter with a mooring in the harbour free of charge the day of departure.
2.3 Fuel, oil, harbour tolls and any consumable material required for boat maintenance during the rental period are at the renter's expense unless otherwise indicated.

3. Cancellation by the renter
3.1The renter cannot change the contracted rental period without the agreement of the local boat rental company.If the renter cancels the agreement for whatever reason prior to the contracted period, the renter will not be entitled to any refund of any instalment payments already made.Should the renter choose not to use the boat during the entire rental period, the renter will not be entitled to any partial refund of the full payment for the boat.The renter may check the availability of cancellation insurances with his insurance company.
3.2 If the subject boat upon delivery cannot cruise due to lack of an essential security part or failure to comply with local regulations and the local boat rental company is unable to offer another boat with equal or superior characteristics, the renter may cancel this agreement and receive a full reimbursement of the contract. The renter will not be entitled to any further compensation.

4. Cancellation by the local boat rental company
If between the time of reservation and delivery, the subject boat becomes unavailable for any reason, the local boat rental company will propose another boat with equal or superior characteristics ( if available).Should this not be possible and any other alternative boat offered is not acceptable to the renter, the renter will be entitled to full reimbursement of the contract.Should the subject boat become unavailable for part of the rental period and using it partially is acceptable to the renter, the local boat rental company will reimburse the renter on a proportionate basis. .

5. Complaints
Any complaint must be sent to CSUK by writing within a month from date of return to be taken into consideration.

6.Liability
CSUK is not liable for any indirect damages caused to the renter such as difficulties between the renter and other passengers arising from the cruise, etc .CSUK and the local boat rental compny are not liable when the non-execution or partial execution of the agreement is either due to the renter, to a third party or to a force majeure.The following non-exhaustive list is considered as cases of force majeure : strikes, lock-out, weather, carrier problems, changes in regulations, etc.

7.Litigation
